Writing a persuasive witness statement for the Property Chamber

Witness statements are the tribunal's primary evidence in most residential property cases. Get them right and cross-examination becomes routine; get them wrong and you undermine an otherwise sound legal case.

Structure

1. Heading: case name, tribunal reference, "Witness Statement of [Name]" and date.
2. Introduction paragraph: who you are, capacity (leaseholder of Flat X), source of knowledge.
3. Chronological narrative: one paragraph per event, past tense, first person.
4. Exhibits: signed and marked (e.g. "[JS-1]"). Each referenced in the text.
5. Statement of truth: "I believe that the facts stated in this witness statement are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth."
6. Signature and date.

Rules of good witness evidence

• Facts, not argument. Save "unreasonable" for the statement of case; the witness statement gives the underlying facts.
• Named, dated, and specific. "On 4 March 2024 the concierge Ms Patel told me…" beats "Someone told me a while ago…".
• Exhibit everything you reference — a witness statement without exhibits is often worthless.
• Do not repeat the bundle. Cross-reference: "See email at bundle page 128".

Common failure modes

• Legal argument in narrative sections.
• Copy-pasting other leaseholders' statements (destroys credibility if inconsistencies are exploited).
• Missing statement of truth.
• Unsigned exhibits.

Cross-examination readiness

Re-read your statement the day before hearing. Highlight anything you would soften or clarify. If a fact is wrong, correct it in writing before the hearing — do not wait to be asked.
